Nathan Payne was convicted of second degree felony murder (assault) for the killing of Bart Foster. On appeal, Payne argues that (1) improper evidence was admitted under ER 803(a)(5); (2) late, midtrial amendment of the charge was per se reversible error; and (3) ineffective assistance of counsel in connection with issues (1) and (2). Because we hold that the trial court did not abuse its discretion in admitting the challenged evidence, and the amendment of the charge did not unduly prejudice Payne, we affirm.
